GENERAL TERMS AND CONDITIONS

These GTC apply to any use of the facilities, courses, products and offers of Peace Yoga Berlin GmbH (hereinafter referred to as "Peace Yoga Berlin") regardless of the place, time and manner of their implementation, unless otherwise stated in the respective contracts. The respective user/customer agrees to the validity and content of these terms and conditions at the latest by booking, agreeing and using the offers. These agreements take precedence over any of the user's own general terms and conditions and take precedence over these.

OFFERS FROM PEACE YOGA BERLIN

Peace Yoga Berlin offers customers a variety of different yoga classes with or without guidance from yoga instructors and trainers. Yoga is a holistic training method for physical and mental exercise. Peace Yoga Berlin does not provide medical or psychological counselling or therapies, nor does Peace Yoga Berlin advise clients on which classes or activities are beneficial for their health or mental wellbeing. Customers choose and book suitable programmes independently, depending on their health conditions, their own performance and their own abilities. Peace Yoga Berlin assumes no liability or responsibility for the selection, usefulness or specific success of individual programmes.

HEALTH STATUS OF THE CUSTOMER(S)

The customer undertakes to use the facilities, courses and offers of Peace Yoga Berlin only if he/she does not suffer from infectious diseases and if there are no medical concerns. In case of doubt, the customer will clarify this with the course instructor before starting the course. Peace Yoga Berlin is entitled to make the use of its facilities, courses and offers dependent on the presentation of a current negative medical certificate if it becomes aware of the suspicion of an infectious disease or the existence of medical concerns; the costs of such a medical certificate must be borne by the customer.

MEMBERSHIPS & BOOKING

Customers can book individual programmes at Peace Yoga Berlin as well as participate in programmes via memberships either with Peace Yoga Berlin itself or with third-party providers.

- Multiple-use cards are contracts of use whichentitle the purchaser to a fixed number of course visits within the selected term. Cancellation is not possible and there is no entitlement to a refund or reimbursement for unused units. Multiple tickets are not transferable unless the multiple ticket is designed as a voucher for this purpose.

- Individual offers are services to be booked and remunerated separately, which are not included in the general utilisation offer of Peace Yoga Berlin (e.g. workshops). The remuneration is based on the agreed rate.

Membership is continuous and renews automatically. Memberships can be cancelled at any time. The minimum term is three months. The cancellation period is one month to the end of the month.

If the customer does not make use of the offers, this does not release him/her from the obligation to pay. There is no entitlement to a refund of payments already made. There is also no entitlement to a reduction in the monthly instalments.

If a customer is in default of payment to Peace Yoga Berlin, he/she can only make use of the offers again after full settlement of the outstanding claims. Until then, there is no entitlement to access to the studio. If a customer is in arrears with two instalments, the following instalments are automatically due immediately until the end of the contractual relationship. In the event of a direct debit not being honoured or returned, Peace Yoga Berlin may charge a flat-rate fee of EUR 36.90 for costs, expenses and processing. The same applies to the initiation of any debt collection proceedings, for which a lump sum of 90 EUR is due.

Membership cannot be suspended.

COURSES AND OPENING HOURS

Peace Yoga Berlin is entitled to determine and limit the maximum number of course participants (course occupancy) depending on the course in general or in individual cases, if this is necessary for organisational, in particular spatial reasons in the interest of the participants. A limit will be specified in the course schedule. Peace Yoga Berlin is entitled to cancel individual courses if there is too little interest in them.

Peace Yoga Berlin is entitled to require pre-registration for the courses in order to ensure an undisturbed organisational process. The introduction of pre-registration will be publicised on the website www.peaceyoga.de and in social media.

In order to enable users to participate undisturbed, access to ongoing course units is only possible for users until the start of the course. There is no entitlement to later access to the studio and participation in the course unit already in progress.

RIGHTS OF CHANGE OF Peace Yoga Berlin

Peace Yoga Berlin is entitled to temporarily change, deviate from or completely cancel the use, the range of courses, the time and location of the individual courses and offers and the general opening hours if this becomes necessary due to maintenance or repair work or urgent organisational reasons or force majeure (e.g. demonstrations, roadblocks, storms, fire, weather, heavy rain/snowfall). The same applies to the temporary cancellation of the service.

PRICE CHANGES

Peace Yoga Berlin is authorised to change the prices for memberships or the use of its facilities, courses and offers in accordance with § 315 of the German Civil Code (BGB). Such a price change only becomes effective if it is announced for at least three full calendar months by means of a generally accessible and clearly visible notice on the premises of Peace Yoga Berlin or by informing the customers concerned in writing, stating the amount of the new prices. The notice replaces the declaration according to § 315 paragraph 2 BGB. The contractual partner is entitled to a one-time special right of cancellation at the time the announced price change becomes effective.

INDIVIDUAL OFFERS (WORKSHOPS OR EVENTS)

Customers can choose individual offersthat also have to be paid for separately, e.g. workshops, training courses or other events. Places are allocated on a first come, first served basis. The number of participants may be limited. Registration for a workshop is binding on both parties. The participant is responsible for the accuracy of the information provided in the registration form.

Registration/booking takes place via our booking partner Eversports.

REFUND MODALITY/CANCELLATIONS

Amounts transferred or due will not be refunded in the event of cancellation or non-participation.If the client is unable to attend the workshop, it is possible to transfer the place to another person after consultation with Peace Yoga Berlin.

Peace Yoga Berlin reserves the right to postpone, substitute or cancel the individual offer in the event of unforeseeable circumstances (e.g. illness of the teacher or similar) or if the minimum number of participants is not reached. In the event of a postponement, participants can choose between attending the alternative date or a refund of the fee already paid.

If the workshop is cancelled without substitution, Peace Yoga Berlin will refund the participation fee. Participants are not entitled to any further claims, in particular claims for damages such as travel or hotel costs in the event of changes or cancellation.
